This Motorsport and Off-Road Use Disclaimer applies to all applicable products sold by GSC Tuning (“GSC Tuning,” “we,” “us,” or “our”), including but not limited to aftermarket automotive parts, performance products, exhaust systems, downpipes, intake systems, turbo-related components, ECU-related products, suspension systems, brake kits, wheels, aerodynamic components, carbon fiber parts, body kits, lighting products, interior modification products, and related accessories.

By purchasing, installing, modifying, or using any product from GSC Tuning, you acknowledge that you have read, understood, and agreed to this Disclaimer.

1. Performance and Motorsport Products

Certain products sold by GSC Tuning are designed, marketed, or intended for performance enhancement, motorsport, off-road use, closed-course competition, exhibition, show use, or specialized automotive applications.

Such products may alter the original configuration, performance, safety characteristics, emissions output, noise level, drivability, handling, braking, suspension geometry, or reliability of a vehicle.

Performance products may not be suitable or legal for use on public roads, streets, or highways in all jurisdictions.

Customers are solely responsible for determining whether a product is legal, safe, and appropriate for their intended use before purchase, installation, or operation.

2. Off-Road and Closed-Course Use

Products described as “off-road use only,” “track use only,” “race use only,” “competition use only,” “closed-course use only,” or similar wording are not intended for use on public roads or highways.

Such products should only be used in legally permitted environments, including:

· Closed-course race tracks;

· Private motorsport facilities;

· Off-road environments where legally permitted;

· Competition events where allowed by event rules;

· Exhibition or show vehicles not operated on public roads;

· Other lawful non-public-road applications.

GSC Tuning makes no representation that any off-road, racing, or competition product is legal for street use unless expressly stated in writing.

3. Customer Legal Responsibility

Customers are solely responsible for understanding and complying with all applicable laws, regulations, inspection requirements, emissions rules, noise limits, equipment standards, insurance requirements, and vehicle registration rules in their jurisdiction.

This includes laws and regulations imposed by:

· Federal authorities;

· State authorities;

· Provincial authorities;

· Local governments;

· Emissions agencies;

· Transportation agencies;

· Inspection programs;

· Motorsport sanctioning bodies;

· Event organizers;

· Insurance providers.

GSC Tuning is not responsible for fines, penalties, failed inspections, registration issues, emissions violations, insurance denial, vehicle impoundment, or other legal consequences arising from the purchase, installation, or use of any product.

4. Emissions Compliance

Certain performance products may affect emissions-related components, emissions control systems, engine calibration, catalytic converters, oxygen sensors, exhaust systems, evaporative emissions systems, or onboard diagnostic systems.

Customers are solely responsible for determining whether a product complies with applicable emissions laws before purchase, installation, or use.

Unless expressly stated in writing, GSC Tuning does not represent or warrant that any performance product is emissions-compliant, street legal, CARB-approved, EPA-compliant, inspection-compliant, or legal for use on pollution-controlled vehicles.

Products intended for motorsport, off-road, closed-course, or competition use may not be legal for use on public roads.

5. Noise and Sound Regulations

Certain exhaust systems, mufflers, downpipes, straight pipes, resonator deletes, intake systems, and other performance products may increase vehicle sound levels.

Customers are responsible for ensuring that any product installed on their vehicle complies with applicable noise laws, sound limits, inspection rules, and local ordinances.

GSC Tuning is not responsible for tickets, fines, citations, failed inspections, complaints, or enforcement actions related to exhaust sound, intake sound, vehicle noise, or public road use.

Sound preference, drone, tone, volume, or personal dissatisfaction with sound characteristics does not constitute a product defect.

6. Vehicle Warranty and Insurance

Installation or use of aftermarket, performance, racing, or off-road products may affect the original vehicle manufacturer’s warranty, extended warranty, service contract, emissions warranty, insurance coverage, or lease agreement.

Customers are solely responsible for determining whether a product may affect:

· Factory warranty coverage;

· Dealer service eligibility;

· Emissions warranty;

· Extended warranty coverage;

· Insurance coverage;

· Vehicle registration;

· Lease or finance agreement terms.

GSC Tuning is not responsible for denied warranty claims, insurance disputes, dealer service refusal, lease violations, or other consequences resulting from vehicle modification.

7. Motorsport and High-Performance Use Risks

Motorsport, racing, track driving, drifting, off-road driving, aggressive street driving, high-speed operation, performance tuning, and competition use involve substantial risk.

Such activities may increase the likelihood of:

· Vehicle damage;

· Mechanical failure;

· Brake failure;

· Suspension failure;

· Tire failure;

· Wheel failure;

· Engine failure;

· Transmission failure;

· Overheating;

· Loss of vehicle control;

· Property damage;

· Personal injury;

· Serious bodily injury;

· Death.

Customers voluntarily assume all risks associated with motorsport, racing, off-road, performance driving, and vehicle modification.

8. No Guarantee of Performance Results

GSC Tuning does not guarantee that any product will produce a specific performance result.

This includes, but is not limited to:

· Horsepower gains;

· Torque gains;

· Lap time improvement;

· Acceleration improvement;

· Braking distance reduction;

· Handling improvement;

· Sound level;

· Fuel economy;

· Reliability;

· Durability under race conditions;

· Compatibility with all existing modifications.

Actual results may vary depending on vehicle condition, installation quality, tuning, fuel quality, supporting modifications, maintenance history, driver behavior, climate, altitude, track conditions, and other factors beyond GSC Tuning’s control.

9. Racing and Track Use May Void Warranty

Unless expressly stated in writing, warranty coverage does not apply to damage, wear, failure, or defects caused by racing, drifting, track use, competition use, off-road use, aggressive driving, overheating, impact, excessive load, or operation outside normal intended use.

This may include, but is not limited to:

· Carbon fiber cracking from impact;

· Exhaust damage from scraping or overheating;

· Brake rotor wear or heat checking;

· Brake pad wear;

· Wheel bending or cracking;

· Suspension damage from track use;

· Tire rubbing from aggressive setup;

· ECU-related vehicle damage;

· Engine or transmission failure;

· Heat-related discoloration;

· Component fatigue from motorsport use.

Products used in motorsport or off-road conditions may experience accelerated wear and may not be eligible for warranty coverage.

10. Professional Installation and Inspection Required

Performance, motorsport, and off-road products should be installed, inspected, adjusted, and tested by qualified automotive professionals.

Before operating a modified vehicle, customers should ensure that:

· All components are installed correctly;

· All fasteners are properly torqued;

· Brake systems are tested;

· Suspension is aligned;

· Wheels and tires have proper clearance;

· Exhaust components are secured;

· Electrical components are properly connected;

· ECU-related products are properly configured;

· The vehicle is safe for intended use.

Customers should not operate a vehicle if there are abnormal noises, warning lights, leaks, rubbing, loose components, overheating, brake issues, steering issues, suspension issues, or any unsafe condition.

11. Event Rules and Sanctioning Bodies

Motorsport events, race tracks, clubs, sanctioning bodies, and organizers may have their own rules regarding vehicle equipment, safety gear, noise limits, emissions compliance, tire requirements, brake requirements, roll cages, harnesses, helmets, and technical inspection.

Customers are responsible for ensuring that their vehicle and installed products comply with all event rules before participating.

GSC Tuning is not responsible for failed technical inspections, event disqualification, denied entry, missed events, registration fees, travel costs, or other losses related to event participation.

12. No Responsibility for Illegal Use

GSC Tuning does not encourage, approve, or authorize illegal street racing, reckless driving, unlawful vehicle operation, emissions tampering, unsafe driving, or use of any product in violation of applicable law.

Customers agree not to use products purchased from GSC Tuning for unlawful purposes.

Any illegal, reckless, negligent, or unsafe use of a vehicle or product is solely the responsibility of the customer.

13. Product Labels and Descriptions

Product labels, product descriptions, packaging, invoices, and website listings may include terms such as:

· “Off-road use only”;

· “Race use only”;

· “Track use only”;

· “Competition use only”;

· “Not for street use”;

· “For closed-course use only”;

· “May not be emissions compliant”;

· “Check local laws before use.”

Customers are responsible for reading and understanding all product descriptions, warnings, disclaimers, and instructions before purchase, installation, or use.

Failure to read a product warning or disclaimer does not relieve the customer of responsibility.

14. No Reimbursement for Related Costs

GSC Tuning does not reimburse or compensate customers for costs related to motorsport, off-road, performance use, or legal compliance issues.

This includes, but is not limited to:

· Installation labor;

· Removal labor;

· Diagnostic fees;

· Tuning fees;

· Track fees;

· Event registration fees;

· Travel expenses;

· Towing;

· Storage;

· Rental vehicles;

· Vehicle downtime;

· Missed events;

· Failed inspection fees;

· Fines or penalties;

· Lost income;

· Lost profits;

· Vehicle damage;

· Any indirect, incidental, special, or consequential damages.

15. Assumption of Risk and Release

By purchasing, installing, modifying, or using any performance, racing, motorsport, off-road, or aftermarket product from GSC Tuning, the customer knowingly and voluntarily assumes all risks associated with such products and activities.

To the fullest extent permitted by law, the customer releases GSC Tuning from liability for claims, damages, losses, injuries, or expenses arising from motorsport use, off-road use, racing, track driving, competition, aggressive driving, illegal use, improper installation, misuse, or failure to comply with applicable laws and safety requirements.

16. Relationship to Other Policies

This Motorsport and Off-Road Use Disclaimer should be read together with our:

GSC Tuning reserves the right to make the final determination regarding whether a product was used in racing, motorsport, track, off-road, aggressive, illegal, or improper conditions.

Such determination may affect warranty eligibility, return eligibility, refund eligibility, available remedies, and future service.
